Terms of Service

1. Acceptance of Terms

By accessing, browsing, registering for, or using the VelaWare platform, website (velaware.xyz), or delivery services (collectively, the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service.

2. Account Registration and Security

To access certain features of VelaWare, you must register for an account. You agree to provide accurate and complete information during registration and to keep this information up to date.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that take place under your account. You agree to notify VelaWare immediately if you become aware of any unauthorized use of your account or any other breach of security.

3. User Content & Script Responsibility

You retain ownership of any Luau scripts, code snippets, project metadata, and configuration data you upload, publish, or manage through VelaWare (“User Content”).

You are solely and fully responsible for the scripts and content you distribute using the Service. You represent and warrant that your content:

  • Does not infringe, misappropriate, or violate any third-party patent, copyright, trademark, trade secret, or other proprietary rights.
  • Does not contain destructive malware, worms, ransomware, or any code designed to compromise user devices or private personal data.
  • Complies with all applicable local, national, and international laws, regulations, and third-party platform terms (including the Roblox Terms of Use).

4. Prohibited Abuse & Conduct

When utilizing VelaWare, you agree that you will not:

  • Interfere with, disrupt, or place unreasonable strain upon the infrastructure, networks, or servers of the Service.
  • Attempt to bypass, disable, circumvent, or impair access controls, rate limits, or security mechanisms of the Service.
  • Attempt to gain unauthorized access to accounts, projects, or private script versions belonging to other users.
  • Reverse engineer, decompile, or disassemble platform software or infrastructure, except to the extent permitted by applicable law.
  • Use the Service for any abusive, unlawful, or fraudulent purpose.

5. Service Availability & Modifications

VelaWare is continuously developing and improving. We reserve the right to modify, enhance, restrict, or discontinue any feature, endpoint, or component of the Service at any time, with or without prior notice.

While we strive to provide reliable and uninterrupted service, we do not guarantee that the Service will always be available, secure, or free from errors or downtime.

6. Suspension & Termination

We reserve the right to suspend or terminate your account and access to the Service immediately and without liability if you violate any provision of these Terms, engage in activities that jeopardize platform stability, or if required to do so by legal process.

You may stop using the Service and delete your projects or account at any time through the dashboard.

7. Intellectual Property

All software, designs, layouts, trademarks, logos, and platform code comprising VelaWare are the exclusive property of VelaWare. Nothing in these Terms grants you ownership of VelaWare's intellectual property.

Your uploaded scripts remain your property, subject only to the limited license you grant VelaWare to host, store, and deliver them as directed by your configurations.

8. Third-Party Services

The Service integrates with and relies upon third-party services for hosting, database persistence, and authentication (including Supabase and hosting infrastructure). Your use of these integrated services may be subject to their respective terms and policies. VelaWare is not responsible for the performance or availability of external services.

9. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VELAWARE, ITS OPERATORS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

10. Changes to the Terms

We may revise these Terms of Service from time to time. When changes are made, we will update the “Last updated” date at the top of this page. Your continued use of the Service following any modifications constitutes your acceptance of the updated Terms.
